STATEWIDE -- New York State's highest court will not hear a challenge to a controversial payroll tax for the MTA.
The Court of Appeals ruling lets a law stand requiring businesses and non-profits in the Hudson Valley and on Long Island to pay on tax on their payroll costs to help fund the MTA. The tax was passed in 2009 to avert service cuts as the MTA faced record deficits.
The state appellate division of the the state supreme court rejected a challenge led by Nassau County in June to label the tax as unconstitutional.
The top court denied a motion to appeal.
